Package #1

Rulemaking Package #1, Public Resources Code (PRC) §2207, Fees Calculation and Schedule

The State Mining and Geology Board (SMGB)  proposes to amend existing regulations in the California Code of Regulations (CCR) pertaining to Fees Calculation and Schedule.  The amendments to CCR sections 3697, 3698, and 3699 clean-up regulatory language based on revisions to statute caused by SB 209 (Pavley), address the fees calculation formula, reset and adjust the low gross exemption maximum income limit and associated fee based on the cost of living as measured by the California Consumer Price Index (CPI), and clarify language for consistency throughout the regulatory sections. The initially proposed regulatory action was published in the California Regulatory Notice Register, No. 39-Z, September 29, 2017. The 45-day formal public comment period for the intial revisions of sections 3697, 3698, and 3699 of Title 14, Division 2, Chapter 8, Subchapter 1, Article 8 of the CCR ran from September 29 - November 13, 2017.

The SMGB has made modifications to the proposed amended regulatory text. A 15-day formal comment period for the modifications of the proposed regulatory text ran from November 16 – December 1, 2017. See links below for associated documents.
