Package #6, Public Resources Code §2774.4(a), Vested Rights Determinations
Effective April 1, 2018, this rulemaking amends section 3950 and repeals sections 3951 - 3965 of the California Code of Regulations, Title 14, Division 2, Chapter 8, Subchapter 1, Article 15.
The regulation makes specific that the issuance of mining permits or the recognition of vested mining rights remains with the local land-use decision making authority regardless if the SMGB acts as the lead agency.
