Public Resources Code §2774 (e): Guidance Document for Surface Mine Inspectors

 

Assembly Bill 1142 (Gray, Chapter 7, Statutes of 2016) (AB 1142), signed by Governor Brown on April 18, 2016, requires the Department of Conservation (Department), through the Division of Mine Reclamation (DMR), to develop and establish an Inspector Training Program for all surface mine inspectors by December 31, 2017.  The Inspector Training Program includes a guidance document providing instructions and recommendations to surface mine inspectors.

DMR proposes to adopt §3504.6 of Article 1 of the California Code of Regulations, Title 14, Division 2, Chapter 8, Subchapter 1 and incorporate by reference a Guidance Document for Surface Mine Inspectors. 

The proposed regulatory action was published in the California Regulatory Notice Register, No. 17-Z (File Number: Z2017-0718-03) on July 28, 2017.  The formal comment period for this rulemaking action will run from July 28 – September 12, 2017.

SMARA Reform Pre-Rulemaking Workshop Information

Inspections and Inspector Training (second round)

A second round of pre-rulemaking workshops were held on March 21st, March 22nd (afternoon), and March 24th, 2017 in Sacramento, Redding, and Santa Ana, respectively.  Each workshop included a brief presentation by DMR staff followed by a discussion of the draft Inspection Guidance Document and draft regulation amendments to California Code of Regulations Section 3504.5.

Inspections and Inspector Training (first round)

The Department, in coordination with the State Mining and Geology Board and stakeholders,  developed a mine inspection guidance document.  The guidance document is required by Section 2774 of the Public Resources Code, as amended by AB 1142.

The first round of Pre-rulemaking workshops were held on November 22nd, November 30th, and December 6th, 2016 in Sacramento, Santa Ana, and Redding, respectively.  Each workshop included a brief presentation by DMR staff and discussion questions for participants.  Please see the Notice of Pre-Rulemaking Workshops and the Guidance document below.
