Package #4, PRC §2770(e) - (g), Reclamation Plan and Financial Assurance Cost Estimate (FACE) Appeals
The SMGB conducted preliminary rulemaking activities pertaining to Surface Mining Operation Reclamation Plan and Financial Assurance Cost Estimate (FACE) Appeals. Pre-rulemaking workshops were held on February 8 and March 9, 2017 in Sacramento and Riverside respectively. The notices and discussion questions can be found below. 


Package #3, PRC §2774 (b), Annual Inspections 
The SMGB conducted preliminary rulemaking activities, pertaining to Surface Mining Operation Annual Inspections, in conjunction with the Division of Mine Reclamation (DMR). The pre-rulemaking workshops were held on November 22nd, 30th, and December 6th, 2016 in Sacramento, Santa Ana, and Redding, respectively. 

The SMGB conducted a second round of pre-rulemaking workshops in conjunction with DMR.  The workshops were held on March 21, 22, and 24th in Sacramento, Redding, and Santa Ana, respectively.


Workshop Discussion Items:


The SMGB continues to work in tandem with DMR to release Annual Inspections regulations and DMR’s guidance document simultaneously.​

Package #2, PRC §2773.1 (a)(4), Financial Assurance Cost Estimate (FACE)​ Form
The SMGB proposes to adopt a Financial Assurance Cost Estimate Form.  The proposed regulatory action was​ published in the California Regulatory Notice Register 2016, No. 48-Z.


The Proposed​ Regulatory Text was revised ​​​subsequent to publication in the Regulatory Notice Register and was available for review and comment for 15 days ending February 27​, 2017. 


Package #1, CCR Section 3698,​ Fees Calculation​​
​The SMGB proposes to amend existing regulations pertaining​ to Surface Mining Operation Annual Reporting Fees Calculation.  The proposed regulatory action was published in the California Regulatory Notice Register 2016, No. 27-z


The Initial Statement of Reasons was revised subsequent to publication in the Regulatory Notice Register, and was available for review and comment for 15 days ending August 22​, 2016.


Additional revisions were made to the Initial Statement of Reasons and Proposed​ Regulatory Text  and were available for review and comment for 15 days ending January 30, 2017.
