​​Rulemaking ​Package #3, Public Resources Code (PRC) ​§2774 (b), Inspections 

The SMGB proposes to amend an existing regulation​ in the California Code of Regulations (CCR) ​pertaining to Surface Mining Operation Inspections. Amedments to the CCR are necessary in order to enact the revisions to PRC section 2774, as amended by Assembly Bill 1142, signed into law on April 18th, 2016, by Governor Brown. The proposed regulatory action was published in the California Regulatory Notice Register, No. 17-Z, April 28, 2017. The 45-day formal comment period for this rulemaking action ran from April 28 – June 12, 2017. 


Taking into consideration the comments from the 45-day formal comment period above, the SMGB made modifications to the proposed amended regulatory text. A 15-day formal comment period for the modifications of the proposed regulatory text ​ran from July 11 – July 26, 2017. See links below for associated documents.

The revised final version of the proposed amended regulatory language for CCR section 3504.5 was adopted by the SMGB at the December 14, 2017 regular business meeting. The rulemaking package is now in its final review with the Office of Administrative Law (OAL). If approved by OAL, the ​​amedend ​regulations will be effective April 1, 2018.
