Rulemaking Package #5, Public Resources Code (PRC) §2773.4(e)(3), Financial Assurance Mechanisms (FAMs) I- Bond Forms
Effective March 7, 2018, this rulemaking action amends Articles 115.1, 115.2, 115.3, 115.4, and 115.5 of Title 11, Division 1, Chpater 2 of the California Code of Regulations to meet the requirement of Public Resources Code section 2773.4 (e)(3). Specifically the updated surety bond forms address the revisions to the Surface Mining and Reclamation Act (SMARA) by preventing FAMs in the form of surety bonds from being released, cancelled, or reduced without the concurrence of both the lead agency and the Department
